Affiliate/Legal Terms for MLMSuperSystem.Com

Affiliate Status:

You must be 18 years of age or older to participate in our affiliate program.

Participation in this program is voluntary. We do NOT import members from other sites without expressed permission. Any member who is given the option of joining through a downline or other referral club MUST confirm their membership in order to be activated.

Members are allowed two free memberships at this time only if the member intends on using each one. "Frontloading" for the purpose of earning commissions is strictly forbidden. Affiliates realize that upon release of the site, there will be upgraded options. Free members are not entitled to earn commissions in any way. Commisions are only earned on the sale of services.

Affiliates must use a valid email address - NOT an autoresponder address when joining.

DO NOT ADD OUR EMAIL ADDRESSES TO YOUR "LISTS" IN ANY WAY. Our response addresses are exclusively for member support, and adding us to mass lists will simply delay our response time for legitimate member questions. Any member found automatically adding us to their newsletters and such without our permission may be removed and all referrals forfeited.

The terms 'partner', 'affiliate', or 'member', or "profit sharing" do not imply any formal association with MLMSuperSystem.Com or its owners and the person does not have any right on our products, logos or trademarks. If a member earns a "profit share" bonus, it is a gifted commission bonus only and does not give any further legal right of investors or the like.

Any tax liability on the amount of commissions received will be the sponsor's responsibility. You are not employed by us nor are you entitled to any benefits normally found in an employer/employee or stock holder relationship. You are required to claim the commissions earned from us on your tax return.

You may not "refer yourself". In other words, you cannot create multiple memberships where you get the commissions for your purchases. Any affiliate found doing this will be subjected to immediate dismissal. Please do not try to get around this or any of our policies.

You may promote your mlmsupersystem affiliate site in any way you deem fit, however you MUST NOT reference the mlmsupersystem.com website in any unsolicited emails (AKA: SPAM). You may reference your url in text ads, safelist or ezine mailings, and so on. Do not reference MLMSupersystem.com in any mass email (spam).  If you choose to do "mass newsgroup" posting - you must be sure that the sites you post to specifically allow promotions. DO NOT "mass post" to newsgroups you are not sure of. If you reference mlmsupersystem.com in a manner that incurs spam reports, we will investigate and deal with each issue individually.

Member Account, Password and Security:

You are entirely responsible for the maintenance and the confidentiality of your user ID and password. In cases where members forget or lose their password, we ask that you follow the instructions on the login page to retrieve it. DO NOT share your ID and password details with others to give them access to your affiliate account, downloads, forums, or any other private members area. Any member found doing so will result in immediate termination and all referrals forfeited.

Use of the Site, Forums and Email/Support:

Members are expected to conduct themselves in a civilized manner and to treat their fellow members with respect. We reserve the right to revoke membership if we feel that a member is not behaving themselves in a proper fashion and member has been warned. Any member found abusing the service, abusing the staff by means of verbal or written abuse, or speaking against the corporation will be immediately terminated, and possibly held legally liable for defamatory abuse. These will be forwarded directly to our legal staff to decide upon.

DO NOT post any pornographic, hate, racist, or other unethical websites on our forums. Those who abuse this will be immediately banned and any and all referrals/commissions forfeited.

You MUST NOT copy any posts from our member forum and post them on other forums without expressed written permission from MLMSupersystem.com's staff. Posts are considered private property of MLMSupersystem.com.

Your use of the services, including any download from the services and any loss of data or other damage to your computer system is at your sole risk. You are responsible for implementing sufficient procedures and checkpoints to satisfy your particular requirements for accuracy of data input and output, and for maintaining a means external to the Site for the reconstruction of any lost data.

In connection with your use of the Site, you agree you will not:

  1. Transmit or submit any message, information, data, text, software or images, or other content ("Material") that is unlawful, harmful, threatening, abusive, harassing, tortious, defamatory, vulgar, obscene, libelous, or otherwise objectionable that may invade another's right of privacy or publicity;
  2. Impersonate any person or entity, including but not limited to, an MLMSuperSystem official, forum leader, guide or host or falsely state or otherwise misrepresent your affiliation with a person or entity;
  3. Post or transmit any Material that you do not have a right to reproduce, display or transmit under any law or under contractual or fiduciary relationships (such as nondisclosure agreements);
  4. Post or transmit any Material that contains a virus or corrupted data;
  5. Delete any author attributions, legal notices or proprietary designations or labels that you upload to any communication feature;
  6. Use the Site's communication features in a manner that adversely affects the availability of its resources to other users (e.g., excessive shouting, use of all caps, or flooding continuous posting of repetitive text);
  7. Post, abuse, or transmit any offensive content, including but not limited to the verbal abuse toward MLMSuperSystem Staff;
  8. Violate any applicable local, state, national or international law;
  9. Spam members through our PM or email systems
  10. Attempt to retrieve confidential information or use any confidential member information for the purpose of creating a "competitor" site that is not in joint venture with mlmsupersystem.com.
  11. Upload or transmit any Material that infringes any patent, trademark, trade secret, copyright or other proprietary rights of any party;
  12. Delete or revise any Material posted by any other person or entity; or
  13. Manipulate or otherwise display the Site by using framing or similar navigational technology without the expressed written consent of MLMSuperSystem.Com.

MLMSupersystem.com is not legally responsible for any spam activities in any way.  MLMSupersystem.com or its owners will not be held liable for any direct or indirect damages due to affiliate's abuse, even if MLMSuperSystem or its authorized representatives have been advised of the possibility of such damages, or (II) any claim attributable to errors, omissions, or other inaccuracies in the service and/or materials or information downloaded through the service.

Equipment.

You shall be responsible for obtaining and maintaining all telephone, computer hardware and other equipment needed for access to and use of the Site and all charges related thereto.

Indemnification.

You agree to indemnify, defend and hold harmless MLMSupersystem.com, its officers, directors, employees, agents, licensors, suppliers and any third party information providers to the Site from and against all losses, expenses, damages and costs, including attorneys' fees, resulting from any violation of this Agreement (including negligent or wrongful conduct) by you or your use and access of the Site. You agree to the injunctive relief to stop such lawsuit or to remove yourself as a participant in the suit. This agreement not to bring or participate in class action suits is an independent agreement and shall survive other relationships.
